What if you have records in multiple states?
Records live with the state of conviction — not the state where you live. If you have convictions in two states, you have two cases running on two different clocks under two different statutes.
The core principle
Each state operates its own criminal history repository. A California sealing order has no effect on a record in Texas. The California court can't order Texas to do anything; the Texas repository wouldn't honor a California order even if it tried.
That means the only way to clear records in multiple states is to run the eligibility analysis state by state and file (or wait for automatic sealing) in each separately.
The FBI — an exception worth knowing
The FBI maintains the Interstate Identification Index (III), a national database fed by the state repositories. State sealing orders do typically propagate to the III — but only when the state forwards the seal notification, which can take weeks to months after the state-level sealing happens.
For background checks that hit the III directly (FBI fingerprint checks, federal employment, certain professional licenses), allow the propagation lag before assuming the seal “worked” everywhere.
Practical sequencing
If you're working with multiple state records, two strategies tend to work better than tackling them at random:
- Lead with the automatic states. If any of your states are Clean Slate states, those records may already be sealed (or sealing soon) without action on your part. Free wins first.
- Assemble the petition packets in parallel. If you need to file in two or three petition states, the supporting documents (certified record copies, restitution-paid letters, probation discharge letters) often overlap. Pulling them once and using them in parallel filings saves runtime.
